Insurance Coverage action Dismissed
Michael P. Kandler obtained a dismissal of a declaratory judgment action involving alleged claims of “advertising injury” brought by Park Place Entertainment Corp. in the United States District Court for the Southern District of New York against a Commercial Excess Insurance Carrier. See Park Place Entertainment Corp. v. Transcontinental Ins. Co., et al., 2003 WL 1913709 (SDNY, April 18, 2003). Park Place was sued in three underlying actions involving the development of casino operations in New York State. The underlying actions involved allegations of tortious interference with business relations, fraud and defamation. Following a motion for summary judgment in which portions of the complaint were dismissed, remaining counts were discontinued.
