Medical Malpractice Defense Verdict
In November 2003, Vincent A. Nagler defended an internist accused of failing to diagnose gastric cancer in a 39 year old man. The plaintiff claimed the doctor failed to appreciate the significance of blood work which would have led to a earlier diagnosis. The plaintiff claimed that he required a total gastrectomy as well as a reduced chance of being cured as result of an alleged 10 month delay in diagnosis. The Queens County jury rejected the claims and returned a verdict in favor of our client.
