 
Premises Liability Defense Verdict
On October 29, 2004, Scott W. Bermack won a jury trial in New York State Supreme Court, Bronx County, on behalf of the owners of a Catskill Mountain hotel and resort. The plaintiff, a guest at the resort, claimed that a defective and dangerous condition of the door to his 2nd floor room prevented his safe egress, resulting in his attempt to exit through the window. Plaintiff, who sustained multiple fractures and who has since undergone numerous surgeries and has been declared permanently disabled, claimed the window sill collapsed as he attempted to lower himself to the ground. Following a five day trial, during which evidence of the plaintiff's prior psychiatric condition surfaced, the jury unanimously rejected the claims and found in favor of our client. The decision is expected to be published in an upcoming issue of the New York Jury Verdict Reporter.
