 
Supermarket Case Dismissed before Trial
In August of 2006, Andrea L. Gatti won a summary judgment motion, obtaining a dismissal of all claims brought by an injured shopper against a national wholesale grocery distributor. Accepting our argument that the client neither created nor had notice of the condition that plaintiff claims caused his accident, Justice Bruce M. Balter (NY Supreme Court, Kings County) granted the motion and dismissed the complaint.
