Order of Summary Judgment affirmed by Appellate Division

Michael P. Kandler represented a building owner on an appeal brough by a tenant claiming property damage from a water main rupture. The Appellate Division affirmed a jury verdict in favor of the defendants, holding that the verdict was fairly supported by the evidence at trial. The Court also rejected the plaintiff’s argument that judgment should have been entered in favor of the plaintiff due to the defendant’s spoliation of evidence.
